Terms and Conditions

These terms and conditions (Terms) apply to Cancer Society’s Day of Yoga (the Event) organised by Cancer Society of New Zealand Auckland & Northland Division (Cancer Society).

The completion of the entry form and payment of the entrance fee constitutes your agreement to be bound by these Terms.

The Terms constitute the entire agreement between the parties and supersedes and cancels any previous agreement, understand and/or arrangement, whether written or not. We reserve the right to change our Terms from time to time by publishing the revised Terms on the Cancer Society’s Day of Yoga website. Please check these Terms regularly for modifications and updates. If you continue to use our system or if you provide any personal information after we make changes, this constitutes your acceptance of those changes and the updated Terms. We will notify you if these Terms change.

1. ENTRY

To be eligible to participate in the Event you must:

  1. Have completed the online registration or otherwise arranged manual registration; and
  2. Match the identification details on the entry form (entries are not transferable); and
  3. Have paid the ticket or registration fee outlined on the Cancer Society’s Day of Yoga website; and
  4. Be 16 years or older;
  5. All participants under 17 must have the consent of a parent or guardian.

 

2. FEES AND PAYMENTS

You agree that:

  1. If you have not paid the ticket or registration fee outlined on the Cancer Society’s Day of Yoga website, you will not be able to attend the in person events or access the live streamed event.

3. PARTICIPANT UNDERTAKINGS

You agree that:

  1. If you and/or your child have a medical condition that may require attention, you have obtained your doctor's clearance; and
  2. You will not charge the Cancer Society for any incidental costs you have incurred in the lead up and during the event; and
  3. Your fundraising activities in the lead up to the event align with Cancer Society’s health promoting messages; and
  4. When you are dealing with the public, sponsors and supporters, you will make it clear that you do not represent the Cancer Society, but you are raising funds to support the Cancer Society; and
  5. You consent to receive and pay for any medical treatment, including from a hospital, clinic or physician or transport by an ambulance, if the treatment is deemed necessary by the Cancer Society or their agents before, during or after the Event.
  6. The use of your name, image, photograph, video and comments may be used in any publication or marketing.

 

4. INDEMNITY & ACCEPTANCE OF RISK

  1. You agree to indemnify all persons, corporations, associations and bodies involved in promoting or staging the Event and their servants, agents, representatives, officers, employees, sponsors and volunteers, including the Cancer Society.
  2. The indemnity in clause 4.1 extends to all liability for injury, loss or damage of any nature however caused connected to your participation in the Event.
  3. You agree to release the Cancer Society together with all other persons, corporations, associations and bodies involved in promoting the event from all actions, law suits, claims, proceedings, demands, losses, damages, penalties and fines however arising (including negligence).
  4. You accept that participation is at your own risk, that risk may include but is not limited to over exertion, dehydration, injury, loss of personal belongings and accidents with other participants or spectators.
  5. You are advised not to participate in the Event if you have had a fever or cold in the past week or have a hangover as these can contribute to exhaustion, dehydration or life-threatening heatstroke.

5. TERMINATION

  1. Failure to comply with these Terms will result in you being ineligible to take part in the Event and/or your withdrawal from the Event.
  2. In the occasion of the event being cancelled, entry fees will be treated as a donation to the Cancer Society unless otherwise arranged with Cancer Society Auckland. Upon request, we can provide you with a donation receipt.

PARENTAL CONSENT

I acknowledge that my Child will participate in the Event run by the Cancer Society of New Zealand (Cancer Society) on the condition that I consent as set out in 1-7 below.

1. AUTHORITY TO GIVE CONSENT

I am a parent or legal guardian of my Child and have the authority to give consent on behalf of my Child to the matters set out in this document. 

2. AGE OF CHILD

I confirm that my Child will be under the age of 16 years (as at the date of the Event). 

3. CONSENT TO PARTICIPATE

I agree that:

  1. I have voluntarily requested to allow my child to participate in the Event; and
  2. I acknowledge that the Event involves physical exertion by my Child for recreational purposes; and
  3. I acknowledge that my Child's participation in the Event is entirely at their, and my, own risk and that I may withdraw my Child from the Event at any time (and that this does not affect any rights we may have under the Consumer Guarantees Act 1993).

4. CONSENT FOR USING CHILD’S EMAIL ADDRESS

I agree that Cancer Society will use my Child’s email address to communicate with them about the Event and run the Event, e.g. encouraging them with fundraising. As this is an online Event, email communication is a necessary part of participation, and if I do not consent to this my Child cannot participate. Cancer Society will never communicate with my Child via email for any purposes other than the Event and will never share my Child’s email address with a third party.

5. NON-TRANSFERABLE ENTRY

I acknowledge that my Child’s registration is not transferable to any other person.

6. ACCEPTANCE CRITERIA AND DATE FOR ENTRY

I accept that if my Child's entry form and payment is not received by the Cancer Society by the registration closing date for the Event, my Child may not be able to participate.

7. CONSENT TO USES OF PERSONAL INFORMATION

I agree that my personal information (and my Child’s personal information) is collected and used by Cancer Society for the purposes set out in the Event privacy policy.
